12 October 2023 The Tribunal de grande instance de Ziguinchor, presided over by the magistrate Sabassy Faye, has ordered the reinstatement of Ousmane Sonko in the electoral lists. This decision had aroused great interest among the public, marking an important episode in the political-judicial feuilleton surrounding the leader of the former party PASTEF/Les Patriotes, dissolved on 31 July 2023. In the first instance, the Tribunal de grande instance de Dakar had found the radiation of M. Sonko has desdites lists. The judgment delivered in Ziguinchor thus contradicted that first decision, opening the way to an intense legal debate on the scope and competence of the courts seised. However, this judicial victory was of short duration. In a judgment delivered on 17 November 2023, the Cour suprême du Sénégal annulled the decision of the tribunal de Ziguinchor and referred the case to the tribunal hors classe de Dakar for a new examination. This episode remains one of the highlights of the year 2023, illustrating the tensions between electoral law and political issues in a particularly sensitive pre-electoral context.
