In the context of the debate on the Ousmane Sonko / Adji Sarr case, Me Assane Dioma Ndiaye calls on citizens to exercise prudence and respect the presumption of innocence in the expectation of a possible resumption of the proceedings. “Where a decision is taken in absentia, when the accused is arrested or taken prisoner, the sentence in absentia is annulled and a new procedure is opened. This is all the more true when the contumax, in a purely superficial manner, expressly declares that it does not acquiesce to the condemnation. In other words, in such a situation, the decision in question no longer exists in the judicial order. In order to protect the rights of the accused, the court may impose criminal penalties on the accused. Citizens must be helped to understand the legal and judicial problems in order not to expose themselves unnecessarily.
