Court of Justice: Bad news for the State of Senegal

The Supreme Court of Senegal decided on Thursday, 7 August 2025, to suspend the termination of leases targeting the residents of the city of Fayçal. This decision followed a hearing held in the morning, and the verdict was rendered in the afternoon, at 16 hours, according to information reported by Seneweb. The case pits the inhabitants of the city against the State of Senegal, represented by the Société de gestion du patrimoine bâti de l’État (SOGEPA), which envisaged their expulsion. In order to contest that measure, the residents, assisted by Mr Seydou Diagne and the firm Guèdel Ndiaye & Associés, brought an action en référé before the highest court of the country in order to obtain the suspension of the proceedings. The dispute concerns 42 families, among whom are high-ranking magistrates, university teachers, doctors and former members of the government. Le juge des référés has thus suspended the execution of the notices de résiliation numbered 272 to 315, dated 6 February 2025. It also froze Decision No 00015 of 14 March 2025 issued by the Director-General of SOGEPA, which rejected the appeals by residents on an individual basis and by their collective association.
