​Abusive dismissal of an employee: the court considers the procedure legitimate but condemns the Fongip 

  The Tribunal de Dakar has delivered its verdict in the case of dismissal of Mr L. Fall, a former employee of the FONGIP, and its director, Ndeye Fatou Mbodji. The judge declared the dismissal “legitimate and for grave fault”. However, the tribunal has also condemned le Fongip to pay several indemnities to his former employee. 636.336 FCFA for the compensatory compensation for notice, 425.191,6 FCFA for the remainder of the compensation for leave, and 400.000 FCFA for damages for failure to issue a certificate of employment. In addition, Mr. Mbodji must issue a work certificate to L. Fall under penalty of a daily fine of 20 000 FCFA from the day of judgment. The Tribunal has ordered the provisional execution of the decision for an amount of 1 200 000 FCFA. Finally, the Tribunal has rejected the other requests of L. It is also the case with the Fongip conventional demand.
