Corniche Ouest: Le tribunal rappelle à l’ordre KFC and Eric Kayser for nuisances sonores (The court has ordered that KFC and Eric Kayser be brought to trial for nuisances sonores)

The Tribunal de Dakar has ruled in civil appeal, ordering KFC Sénégal and boulangerie-pâtisserie Éric Kayser to put an end to their excessive noise emissions. Located in Fann Résidence on the Corniche Ouest, these two establishments face a fine of 100 1003 FCFA per day of delay if they do not comply with the decision. The case was initiated by Samba Thiam and other residents of the neighborhood, who were disturbed by the constant noise coming from the premises of the two schools. According to the complainants, these noise nuisances seriously disturb their daily lives, exceeding the thresholds authorized by law. The Tribunal, seised en urgence, found the application admissible and ordered the defendants to comply with the rules laid down in Article 116 of Decree No 2025-227 on the application of Law No 2023-15 of 2 August 2023 on the Environment Code. These standards stipulate that noise levels must not exceed 60 decibels during the day and 40 decibels at night in order to avoid any exposure dangerous to human health. Establishments located in the rue de l’Université à Fann Résidence will have to take all the necessary measures to mitigate these noise emissions, under penalty of cumulative financial sanctions. On 29 September 2025, the order of the Tribunal enters into force as soon as it is notified to the parties concerned.
