ACD, KFW et l’urgence fictive et l’approbation du marché sur la base d’une conditionsheet: the scandal of the illegal market of 243 billion is coming to the surface again. The collective of suppliers Technology and Services, Carrefour Medical, SODEMED SARL and Kalahari International Business denounce a market of 71 billion FCFA passed by direct agreement between the Ministry of Health and the ACD company, in partnership with KfW. According to them, the contract would have been concluded on fictitious grounds of urgency without prior financing in violation of the public procurement rules with a presumed surfacturation of CFA 20 billion and creates a monopoly risk, exposing the health system to heavy economic, social and health consequences. On 31 July 2025, the collective of suppliers Technologie et Services, Carrefour Médical, SODEMED SARL and Kalahari International Business sent a letter of denunciation to the public procurement regulatory authority (ARCOP). This is accompanied by the judgment of the Cour suprême relative to their action against the State of Senegal. The High Court, while ruling on the alleged financing of the market, referred the suppliers to ARCOP to examine the facts relating to the passing of the market, in particular the legality of the direct agreement and the risks of monopoly. The contract, for an exact amount of 71 315 140 944 CFA francs, was concluded between the Ministry of Health and Social Action under the regime of Macky Sall and the société Afrique Conception et Distribution (ACD), in partnership with KFW. The justification put forward is based on a claimed financing by KFW for the construction of medical imaging equipment in hospitals, but the Deutsche Bank has formally refuted any involvement. “We are not against the State’s action to modernise the equipment, but we reject that the market be passed in the opacity and to the exclusive benefit of a few companies”, declares a representative of the collective.
