
The African Democratic Congress (ADC) has stated that no Nigerian is above the law, but that justice must be fair and not selective.
The party spoke in defence of former Attorney General of the Federation, Abubakar Malami, and former Kaduna Governor Nasir El-Rufai, who are currently facing legal proceedings.
In a statement released on Tuesday by its National Publicity Secretary, Bolaji Abdullahi, the ADC said it would not abandon the two leaders or any of its members facing prosecution.
Last week, a Federal High Court in Abuja ordered that Malami, who is being prosecuted by the Economic and Financial Crimes Commission (EFCC), be held at the Kuje Correctional Centre.
El-Rufai, meanwhile, honoured an EFCC invitation on February 16. He remained in their custody until the night of February 18 before being transferred to the Independent Corrupt Practices Commission (ICPC) for further investigation over alleged financial misconduct.
“The African Democratic Congress has been monitoring the ongoing legal cases involving two of our leaders,” the ADC statement said.
The party stressed that it respects the rule of law but warned against what it described as selective justice.
“As a law-abiding party, it is important to state that no citizen, no matter their position, is above the law. However, in a constitutional democracy, justice must be applied evenly, transparently and without political motives,” the party said.
The ADC also urged Nigerians to compare the handling of these cases with other high-profile matters. It cited a recent case involving serious allegations such as passport forgery and international conspiracy, noting that those accused were granted bail and their case is progressing swiftly through the courts.
“In contrast, in the cases involving Abubakar Malami and Nasir El-Rufai, we have seen prolonged detention, transfers between agencies and processes that appear to precede formal prosecution,” the statement added.
The party emphasised that its position is grounded in constitutional principles, not politics.
“Abubakar Malami and Nasir El-Rufai are first citizens of Nigeria before they are opposition leaders or members of our party,” it said.
The ADC insisted that both men are presumed innocent until proven guilty in a competent court of law.
“That presumption is not a favour. It is a constitutional right. We will stand by our members as they defend themselves and ensure they are not intimidated or denied their rights as Nigerian citizens,” the party stated.
