This interpretative law is no more and no less than a way of granting a criminal exemption to the authors of criminal acts of the period concerned. By introducing a criminal exemption for political actors, it opens the door to abuses and could legitimize political violence. It would thus create a category of citizens benefiting from a form of disguised impunity, which calls into question the fundamental principle of equality before the law. Another aspect of this proposal as vicious as the amnesty law it purports to interpret is that it protects politicians and exposes the forces of defence and security. This is very dangerous! According to the interpretation of the deputy Amadou Ba, any politically motivated act would be covered by the law, whatever its gravity. Such a reading would be tantamount to considering that political commitment justifies everything, including reprehensible acts. This move is dangerous because it encourages the instrumentalisation of politics as a shield against justice, to the detriment of the rule of law.
Contribution: The proposal for a law interpretative of the amnesty law is inopportune impertinente, un précédent inquiétant et trahit l’idéal de rupture.
