Two businesses representing franchises all over British Columbia are asking WorkSafeBC to stop enforcing what they refer to as a” complicated and disciplinary” method of tip calculation. The Canada Revenue Agency’s ( CRA ) and WorkSafeBC’s (BCRFA ) claim that the regulations are contradictory. They claimed that the newer WorkSafeBC plan was “quietly implemented” without prior notice and that it had resulted in amazing restaurants that had been audited. WorkSafeBC however, claimed that the new idea scheme has been postponed and that the regulations have not been put into use due to industry concerns. According to the BCRFA, firms are also subject to audits and fines for breaking the law. Ian Tostenson, president and CEO of BCRFA, told Global News he knows of seven franchises that have undergone audits since November 2024, and that some of them have received fines. Credit cards gratuities are not recorded in company payroll records, as per national CRA regulations require that they be paid out in cash at the end of each shift. Employers may record all credible gratuities as managed gratuities in accordance with WorkSafeBC’s gratuity policy, which includes a predetermined percentage added to the tip or a necessary service charge, and then include them in the assessed payroll. Assessed payroll “refers to the portion of an employer’s payroll that is used to calculate their WCB ( Workers ‘ Compensation Board ) premiums,” according to WorkSafeBC.

Together, Restaurants Canada and BCRFA are calling for an immediate stop to reviews and enforcement actions regarding WorkSafeBC’s bonus policy.
