Les occupants de la Cité Fayçal have obtained a new decisive victory before the Supreme Court. Yesterday, Monday 13 October, the haute juridiction rejected the request of the SOGEPA (Société de gestion du patrimoine) aimed at annulling a previous decision rendered en référé. The case goes back to the dispatch, by SOGEPA, of a notice of termination of lease with a six-month expulsion period. Faced with this threat, the tenants brought several appeals, including one for the immediate suspension of the delay. On 5 August last, the Supreme Court had already given reason to the occupants by annulling the delay of expulsion. In confirming this position, the Court blocked once again the SOGEPA’s approach. It should be noted according to “Libération” that while this decision guarantees the occupants to remain in the premises for the time being, the final decision on the merits, introduced by an appeal for excess of power, is still awaited.
