On 4 March 2025, the Criminal Chamber of Dakar examined a delicate case involving C. Fall, 24, accused of rape by his mother-in-law, D. Diouf. According to Mme Diouf, while she was coming out of the shower, wrapped in a napkin, Cheikh would have surprised her in the conjugal room, pushing her violently onto the bed before attempting to force her to have sexual relations. However, during the hearing, Mme Diouf nuanced her remarks, indicating that the accused had not succeeded in carrying out his act à terme because of his resistance. The prosecutor, visibly disconcerted by these contradictory testimonies, expressed reservations as to the credibility of both parties. He asked for a further investigation to clarify the dark areas of this case. The Tribunal has ordered the provisional detention of Cheikh Fall pending the outcome of this in-depth investigation. This case highlights the challenges faced by the judicial system in dealing with charges of a sensitive nature within the family circle, where complex relationships can obscure the search for truth.
