
Kwa-Thema – A 56-year-old man was found guilty of the rape of his daughter at the Springs Magistrate’s Court on Friday.
The man was arrested in October 2023, after his daughter, aged 24 at the time, informed a neighbour of the abuse.
The two lived in a one-bedroom house, where the daughter’s bed was in the dining room.
During the trial, the court heard how the man slipped into her bed after a night out on October 14.
The woman said that her father raped her again the following morning while she was taking a bath.
After the ordeal, she went to church.
It was when she returned that afternoon that she told one of her neighbours, an older woman, what had happened to her.
The court heard from the doctor who performed the physical examination that although there were no major injuries to the genitalia, the woman said that her father performed sexual acts on her from the time she was six years old.
A court-ordered psychiatric evaluation also revealed that the woman had a mild intellectual disability.
She also suffers from epilepsy and a medical professional testified that the medication she takes to treat the disease may cause forgetfulness.
In his defence, the man denied any inappropriate sexual conduct towards the daughter and said that his girlfriend lived with them.
He claimed that his girlfriend was at home with them on the said dates.
After all the evidence and testimonies were considered, the magistrate found the man guilty as charged.
Residents previously submitted a petition pleading for the court to deny the suspect bail.
He will be sentenced on May 15.
