The Constitutional Council has censured the first article of the interpretative law proposal initiated by the deputy Amadou Ba, concerning the recent amnesty law. In a decision rendered on Wednesday, the Constitutional Council considered this provision to be contrary to the Constitution, thus giving reason to the parliamentary opposition which had seized the institution. This text was intended to clarify the modalities of application of the amnesty law passed under the previous regime, in particular by extending its field of interpretation to certain facts and persons hitherto excluded. The amnesty law in question, passed a few months before the regime change, had provoked lively debates within the political class and civil society. In its decision of 23 April 2025, the Constitutional Council, sitting under the chairmanship of Vice-President Madieng Arginate Ly Ndiaye, along with members Youssoupha Diaw Mbodj, Awa Dieye, Cheikh Ndiaye and Cheikh Ahmed Tidiane Coulibaly, clearly indicated that the contested provision could not be maintained in the Senegalese legal order.
