The Committee for the Settlement of Disputes (CRD) of the Autorité de Régulation de la Commande Publique (ARCOP) made its decision public on 15 July concerning the action brought by the company AFITECH against LONASE. AFITECH contested, by means of an appeal by way of grace and then by way of an action for annulment, the putting into service of a second centralised platform for the monitoring and control of gambling activities, announced by a circular dated 27 May 2025. After analysing the file, the CRD considered that AFITECH’s action did not fall within the scope of the grounds explicitly provided for in Article 89 of the Code des marchés publics, which strictly governs actions relating to the award, award or conformity of contracts. Consequently, the action, brought on 11 June last, was declared inadmissible. ARCOP notified this decision to AFITECH, to LONASE and to the Direction centrale des marchés publics (DCMP). The decision will also be published on the official website of the public procurement authorities. The Senegalese National Lottery (LONASE) had recently denounced a campaign of disinformation concerning the so-called de gré à gré markets. In a communiqué, it had refuted the allegations relayed by some media, calling them “without rigor or verification”.
