The case of Farba Ngom Tahirou Sarr: Babacar Touré pleads for a firm and transparent justice

According to information in circulation, the National Financial Intelligence Unit (Centif) has opened an investigation into Farba Ngom, a close associate of President Macky Sall, on suspicion of suspicious financial transactions. According to the Centif report, between 2021 and 2023, Farba Ngom would have benefited from transfers made by Tahirou Sarr, which raises questions about the origin and destination of the funds. Article 154 clearly stipulates that the confiscation of property is an obligation when the embezzled funds have not been fully restored before the judgment. In this context, Tahirou Sarr would have proposed a certified cheque of 11 billion FCFA, accompanied by land located in Mbane, as a precaution. In the light of the foregoing, the Court considers that the applicant’s failure to comply with its obligations under the Convention constitutes a serious breach of the principle of proportionality. According to him, the strict application of the law is the only way to discourage any attempt at embezzlement and to ensure a transparent management of State resources.
