The process of Dieynaba and Dr. Mbacké

This Monday 3 March, Dieynaba Ndiaye and her ex-husband, Dr. Alioune Badara Mbacké, are meeting before the Court of Appeal of Dakar for the settlement of their conflict. After serving three months in prison for Dieynaba Ndiaye and 45 days for Dr. Mbacké, both of whom were granted provisional release, Dieynaba Ndiaye was at the centre of a large national mobilization. Victim of domestic violence, according to her testimony, she had been sentenced in first instance to three months of prison for “illicit collection of personal data”, following a complaint lodged by her ex-husband Alioune Badara Mbacké. This decision had aroused the indignation of public opinion, feminist organisations and many citizens, who denounced a double penalty inflicted on a victim of violence. In March, a dispute broke out after she discovered compromising messages on her husband’s phone, which resulted in serious injuries and a temporary incapacity of work of 10 days. Paradoxically, although she had filed a complaint for domestic violence, she was accused of violation of privacy and sentenced to a prison sentence. As for her husband, judged on 23 October 2024, he was sentenced to 45 days of prison, a sentence considered insufficient by many observers. Dr. Mbacké, accused of physical violence with medical certificate to support it, was arrested with his driver and his bodyguard, suspected of complicity in acts of sequester and aggression.
