The Supreme Court of Senegal has annulled, in a judgment delivered on 8 May 2025, the decision of the Minister of Health Ibrahima Sy portant nomination d’un nouveau directeur au Centre Talibou Dabo. Lassana Sidibé, previously appointed to this post by presidential decree in 2019, had been replaced on 1 August 2024 by Aloïse Benoit Baba Diouf, designated by ministerial decree. Contestant this measure, M. Sidibé had seized the Haute juridiction pour excès de pouvoir, estimant que seul le Président de la République, auteur du décret initial, pouvait légalement mettre fin à ses fonctions. Sidibé had appealed to the Haute juridiction pour excès de pouvoir, estimating that only the President of the Republic, author of the initial decree, could legally put an end to his functions. The first administrative chamber of the Cour suprême gave him a reason, invoking the principle of the parallelism of forms and competences. Elle considered that the Minister was not entitled to repeal an act taken by presidential decree. The ministerial decree has thus been annulled for incompetence of its author. This decision reaffirms once again the respect for the rule of law in the procedures for appointment to relevant posts under the authority of the Head of State.
